Free trademark filing checklist
Updated November 1, 2026

A printable checklist of what to prepare before you file a U.S. trademark application with the USPTO.
Before you file
- Search the USPTO trademark database for identical and similar marks in related goods or services.
- Decide who owns the mark (you or your company) and use that exact legal name on the application.
- Write a clear description of your goods or services and identify the right classes.
- Decide whether you are filing based on current use or an intent to use the mark.
What to have ready
- A clear image of the mark if it is a logo (a special-form drawing) or the exact wording if it is standard characters.
- A specimen showing the mark as customers see it, if it is already in use.
- The date you first used the mark anywhere and in commerce, if it is in use.
- A USPTO.gov account with verified identity.
After you file
- Watch your email and the application status for office actions and deadlines.
- Plan maintenance filings; registrations need declarations between years 5 and 6 and renewals every 10 years.
- Foreign-domiciled applicants must use a U.S.-licensed attorney.
